The following terms and conditions govern your use of the CURA software (the Software) made available through our website www.cura-technologies.com (the Website).
The CURA software is provided by CURA TECHNOLOGIES PTY LTD (ABN: 81 670 753 483) (referred to as 'we', 'us' and 'our') to users (referred to as 'you' and 'your') pursuant to a commercial arrangement between us and the organisation that has granted you access to the CURA software (the Organisation).
These Terms, along with our Privacy Policy and any order forms, constitute a binding contract between you and us. CURA Technologies reserves the right to revise these Terms at any time, with changes taking immediate effect. Your continued use of our software after notification of changes indicates your acceptance of the modified Terms.

1. Agreement to Terms and Conditions
To use the CURA software, you must first complete the registration process. By doing so, you agree to comply with these terms and conditions.
Please read and understand these terms carefully. If you do not agree to comply with these terms and conditions, please exit the Website at www.cura-technologies.com. You will not be permitted to use the CURA software without agreeing to these terms.
Nothing in these terms and conditions shall be construed as constituting a partnership, joint venture, employment or agency relationship between you and us, or between you and any other user. Neither party has the authority to bind the other in any way.
2. Your Responsibilities
You warrant that:
- Your registration details are true, accurate and complete
- You will maintain and promptly update your details to keep them current
- You will not transfer your registration to another user
- You are solely responsible for maintaining the security of your account
- You will keep your password secure and not share your username or password
- You will immediately notify us of any unauthorised use or security breach
- You will comply with any acceptable use policies we publish
You must not:
- Attempt to gain unauthorised access to our systems or content
- Use false contact information or impersonate others
- Disrupt or negatively impact the CURA software's operation
- Use the Software in any way that violates applicable laws or rights
- Modify, reproduce or resell any content or materials from the Software
- Upload any malicious code or harmful content
- Attempt to circumvent any access restrictions or security measures
3. Our Responsibilities
We commit to:
- Providing and maintaining the CURA software service in accordance with these terms
- Meeting our stated service level commitments
- Implementing industry-standard security measures to protect your data
- Providing timely updates and improvements to the service
- Ensuring appropriate technical support during business hours
- Maintaining adequate backup systems and procedures
- Notifying you of any significant changes to the service functionality
4. Subscription Management
Your subscription allows you to manage user access according to your organisation's needs. You can modify user roles, adjust access permissions, and manage account settings through our administrative interface. We provide flexibility to scale your subscription up or down based on your requirements.
Subscriptions are available on monthly or annual terms with automatic renewal. All fees are billed in advance and are non-refundable. Changes to subscription levels are prorated to your billing cycle. We provide notice of any fee changes 30 days in advance. All prices are in Australian dollars and include GST.
5. Refund Policy
We do not offer refunds for any payments made. You may cancel your subscription at any time, and no further charges will apply for subsequent billing periods. You will remain responsible for all fees and charges (including GST) incurred during the current billing period, whether on a monthly or annual plan. Upon cancellation, you will retain access to your account and services until the end of the current paid billing period. Any outstanding SMS charges will be due and payable immediately upon cancellation of your account.
6. Term and Termination
Your subscription to the CURA software continues until terminated by:
- Non-renewal of your subscription
- Breach of these terms
- Excessive or abusive usage
- Non-payment of fees
- Mutual agreement
Upon termination:
- You will have 30 days to export your data
- Access to the service will cease
- You must cease using any associated APIs
- We will securely delete your data after 90 days
- Any outstanding fees become immediately due
7. Technical Requirements
The CURA software is accessible through modern web browsers with standard internet connectivity. We recommend maintaining current browser versions and stable internet connections for optimal performance. Specific technical requirements are documented in our support materials.
8. Service Availability and Performance
We maintain a target system availability of 99.9%, measured monthly, excluding:
- Scheduled maintenance windows with minimum 48-hour notice
- Emergency maintenance or critical security updates
- Force majeure events or circumstances beyond our reasonable control
- Third-party service interruptions affecting our infrastructure
Our status page displays real-time service availability, and we strive to minimize any disruption to your business operations.
Technical Support operates during Australian business hours (9am-5pm AEST). Support requests are prioritized based on severity:
- Critical system issues receive initial response within 2 hours
- High-priority matters are addressed within 4 business hours
- Standard requests are handled within one business day
We continuously monitor system performance through automated health checks and regular optimization processes. Monthly service level reports are available upon request. Our technical team proactively addresses performance issues to maintain optimal service delivery.
9. Software Updates and Modifications
As a software service provider, we:
- Regularly update the software to improve functionality and security
- May modify features and interfaces with reasonable notice
- Will maintain backwards compatibility where practical
- Provide release notes for significant updates
- May deprecate features that are outdated or underutilised
Updates are typically deployed during scheduled maintenance windows with minimal disruption. Feature updates include appropriate documentation and, where necessary, user training materials.
10. Service Evolution
We are committed to continuous improvement of our software. This includes regular feature updates, performance enhancements, and security improvements. While we may modify features over time, we strive to maintain backward compatibility where possible and provide adequate notice of significant changes.
11. Service Monitoring
We monitor:
- Service performance and availability
- User access patterns and feature usage
- System security and potential threats
- API usage and integration performance
- Error rates and system health metrics
This monitoring is essential for maintaining service quality and security.
12. Integration and API Usage
The CURA software may:
- Offer integration capabilities with third-party services
- Provide API access subject to separate terms and usage limits
- Support data interchange with approved external systems
- Require additional authentication for integrated services
- Have dependencies on third-party services for certain functions
Our software supports integration with authorized third-party services through our API. Integration usage is subject to our API terms and fair use policies. We maintain documentation for supported integrations and provide necessary technical specifications for implementation.

All customer data is hosted in Australia, adhering to Australian privacy laws and data protection standards. We maintain secure backups with defined retention periods and implement strict data handling protocols. Our staff and contractors operate under confidentiality obligations regarding your information.
During your active subscription, you maintain full access to your data with export capabilities in standard formats. Upon subscription termination, we retain your data for 30 days to facilitate transition. After this period, we securely delete all data following industry-standard protocols.
15. Data Protection and Privacy
We take data protection seriously. When using the CURA software:
- Your personal information is handled as per our Privacy Policy
- We employ industry-standard security measures
- Our team and contractors follow strict confidentiality protocols
- You must maintain the confidentiality of any sensitive information
- We comply with Australian privacy laws and regulations
16. Business Continuity and Security

17. Intellectual Property Rights

Your subscription grants you a right to access and use the service, not ownership of the software itself.
18. Limitation of Liability
To the maximum extent permitted by law:
- We exclude all implied conditions and warranties
- We are not liable for any indirect or consequential loss
- Our total liability is limited to fees paid in the prior 12 months
- You use the Software at your own risk
- We do not guarantee uninterrupted or error-free operation
19. Consumer Law Rights
These terms incorporate all mandatory consumer guarantees under Australian Consumer Law. Where such guarantees apply, our liability is limited to one or more of the following remedies (as we determine appropriate):
- Re-supplying the affected service or functionality
- Providing you with equivalent alternative features
- Refunding the fees paid for the affected service period
- Such other remedy as prescribed by law
20. Governing Law
These terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of Victorian courts for any disputes.
If any provision is found invalid, it will be modified to the minimum extent necessary or severed, with remaining provisions continuing in full effect.
